Negligence Per Se

What it means

When a defendant violates a safety statute and that violation causes the injury the statute was designed to prevent, negligence is presumed without needing to argue what a reasonable person would do.

Arizona context

Arizona courts apply negligence per se when a statute imposes a specific duty for the protection of a class of persons that includes the plaintiff, and the defendant violated it.
