Notice of Claim

What it means

A formal written notice required before suing a government entity. Must include facts establishing liability and a specific settlement demand. Arizona requires this within 180 days of the injury.

Arizona context

Under ARS 12-821.01, a Notice of Claim must be filed with the public entity within 180 days of when the cause of action accrues. A minor, or a person who is insane or incompetent, may file within 180 days after that disability ends.

The lawsuit itself must then be filed within one year. Missing the notice deadline is a complete defense to the claim, but the public entity must raise it or it waives the defense.
