Premises Liability

What it means

The legal responsibility property owners have to keep their premises reasonably safe for visitors. The duty owed depends on whether the visitor is an invitee, licensee, or trespasser.

Arizona context

Arizona follows the traditional three-tier system. Business invitees get the highest duty of care, social guests (licensees) get a lesser duty, and trespassers get the least. Children may be owed a higher duty under the attractive nuisance doctrine.
