Pure Comparative Fault

What it means

The Arizona rule that allows an injured plaintiff to recover damages even if they were more than 50% at fault. The recovery is simply reduced by the plaintiff’s percentage of fault.

Arizona context

Most states use a ‘modified comparative fault’ rule that bars recovery if the plaintiff is 50% or 51% at fault. Arizona is one of about a dozen pure comparative fault states.
