Damages awarded to punish a defendant for especially harmful behavior and to deter similar conduct. Available only when the defendant acted with malice, fraud, or gross negligence.

Arizona requires clear and convincing evidence of an ‘evil mind’ to support punitive damages. Routine negligence isn’t enough. The conduct must show conscious disregard for the rights of others.
