Comparative Fault

What it means
A system that reduces a plaintiff’s recovery in proportion to their share of fault for the injury. Arizona is a ‘pure comparative fault’ state.
Arizona context
Arizona allows recovery even if the plaintiff is 99% at fault. Damages are reduced by the plaintiff’s percentage of fault. Codified in ARS 12-2505.
